Terms of Service

Please read these Terms of Service carefully before purchasing tickets or using any Bluestar Airlines service. These terms govern your relationship with Bluestar Airlines and apply to all passengers, members, and website visitors.

1. Acceptance of Terms

By accessing or using Bluestar Airlines' website, mobile application, or booking services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services. These Terms constitute a binding legal agreement between you and Bluestar Airlines, Inc. ("Bluestar," "we," "us," or "our").

2. Ticket Purchase & Reservations

All fares are quoted in U.S. dollars and are subject to change until purchase is complete. A reservation is not confirmed until full payment is received and a booking confirmation with a reference number is issued to you. Fares displayed are per person unless otherwise stated. We reserve the right to correct any pricing errors at any time prior to ticket issuance, even after a booking has been submitted.

3. Cancellations & Refunds

Non-refundable tickets may be exchanged for a Bluestar travel credit, minus any applicable change fees, for travel within one (1) year of the original purchase date. Refundable fares may be canceled for a full refund to the original form of payment within 24 hours of purchase, provided the departure date is at least 7 days away. After 24 hours, refundable tickets may be refunded subject to the applicable fare rules. In the event Bluestar cancels a flight, passengers will be offered a full refund or re-accommodation on the next available flight at no additional charge.

4. Flight Changes

Passengers may change their itinerary subject to fare rules and any applicable change fees. Same-day confirmed changes are available for eligible passengers for a fee, subject to availability. Bluestar reserves the right to change schedules, aircraft type, routing, or cancel flights due to operational, safety, or regulatory requirements. In such cases, we will make reasonable efforts to notify affected passengers and provide alternative arrangements.

5. Baggage Policy

Carry-on and checked baggage allowances vary by fare class and Constellation membership tier. Fees apply to checked bags beyond included allowances. Bluestar is not responsible for damage to fragile, improperly packed, or perishable items. Lost or damaged baggage claims must be reported within 24 hours of arrival for domestic flights and within 7 days for international flights. Bluestar's liability for lost or damaged baggage is limited in accordance with applicable law.

6. Check-In & Boarding

Passengers must check in and be at the gate no later than the times specified at booking. Bluestar reserves the right to deny boarding to passengers who arrive after the check-in deadline. Passengers denied boarding due to oversales will be compensated in accordance with U.S. Department of Transportation regulations. Valid government-issued photo identification is required for all travelers. International travelers are solely responsible for ensuring they hold valid passports, visas, and any required travel documents.

7. Constellation Loyalty Program

Enrollment in the Constellation program is free and subject to the Constellation Program Terms & Conditions, incorporated herein by reference. Miles earned are not transferable, have no cash value, and may expire in accordance with program rules. Bluestar reserves the right to modify, suspend, or terminate the Constellation program at any time. Tier status and benefits are based on qualifying miles flown within a program year and are subject to change.

8. Conduct & Safety

Passengers must comply with all crew member instructions and federal aviation regulations at all times. Bluestar reserves the right to deny boarding to or remove any passenger who poses a safety or security risk, is disruptive, intoxicated, or otherwise unfit to travel. Any prohibited or dangerous items are strictly forbidden on board. Violations may result in permanent travel bans and legal action.

9. Limitation of Liability

To the fullest extent permitted by law, Bluestar's liability for any claim arising out of or related to these Terms or your use of our Services shall be limited to the amount paid by you for the applicable ticket or service. Bluestar shall not be liable for any indirect, incidental, consequential, or punitive damages. Nothing in these Terms shall limit liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Wilmington, Delaware. You waive any objection to the laying of venue in such courts.

11. Changes to These Terms

Bluestar reserves the right to update or modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our Services following any such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
